This data Privacy Notice statement explains how next:urban technologies GmbH and its subsidiaries (“next:urban”) handle and process personal data collected on the website www.nexturban.at and its subsites, as well as personal data generated by other communication with you, unless an existing contractual relationship with you already provides you with the requisite information.

We also inform you about your rights as a concerned person, and how you may control collection and processing of your personal information.

1.1 Contacting us without using our website

If you contact us by other means of communication than our website, for example by phone, email, instant messaging or by sending us a hardcopy letter, we will process at least your name, contact data and the fact that you have contacted us and when you did so electronically, by entering it in a database which is appropriate for handling your enquiry. If necessary for understanding or resolving it, we will process any other personal data you have voluntarily provided us with during the course of your request, thus based on your consent and the purpose defined by you (Art 6(1)(a) GDPR). If you contact us in relation to a new project, we will conduct the processing on the basis of Art 6(1)(b) GDPR.

We will delete your personal data once your enquiry has been resolved and our record retention obligations under applicable statutory regulations have been fulfilled.

In case you have contacted us to request to receive newsletters or other information from next:urban from time to time, for example by giving us your business card and asking us to put you on our mailing lists, you may revoke this consent at any time without providing reasons. To revoke your consent, please use the contact form or the unsubscribe link indicated in our newsletters and in similar emails sent to you.

1.2 Publicly available areas of our website

You can use the publicly accessible areas of nexturban.at without disclosing your identity. In case we explicitly ask you for personal information (e.g. name, e-mail address, relevant region/market), for example when you use the contact form or register for a newsletter, you do so voluntarily. We only use the information provided by you for our own business purposes, such as sending you the requested material.

If you communicate with us by using a contact form on nexturban.at, the information marked as “required” is necessary for us to efficiently handle your enquiry. You may provide any further information voluntarily. We thus process the information provided by you through the contact form on the basis of your consent (Art 6(1)(a) GDPR). We will delete this personal data once your enquiry has been resolved and our record retention obligations under applicable statutory regulations have been fulfilled.

1.3 Areas requiring a login

1.3.1 Subsites available to customers

Several areas of our website are available to customers only and require dedicated login credentials, such as the areas where a customer can submit various support tickets. While links to these areas are provided in the section “Support” on the website, customers would have already received the necessary information to login to these areas in the course of the project.

Any personal data exchanged between you and next:urban in such areas is governed by the contract between next:urban and your organisation and the data protection provisions of that contract. In case you are required to self-register for a customer service in order to use it, the personal information you might have entered (e.g. name or login ID, contact data, your organisation) and which is marked as required by us is necessary to link your account to the relevant customer contract and perform authorisation checks, and will only be used by us for that purpose. We will delete your personal data pursuant to the contract which was concluded between your organisation and next:urban technologies GmbH or one of its subsidiaries.

1.3.2 Job applicants – career.nexturban.at

You can read our job offerings without having to disclose your identity. In order to apply for an offering or to express your general interest in working for next:urban, you first need to register at our “Careers at next:urban” portal by entering your name and e-mail address. This information is used to administer your account on a technical level. How we use your name, contact data and any further information you provide to us beyond registration is explained by the Data Privacy Notice for Job Applicants, which is notified to you before you enter your data in that area of our website.

1.4 Cookies

Our website uses so-called “cookies”. Cookies are small text files which are stored by our website on your computer. They enable us to analyse how our website is used and also allow us to see when you visit our website again. You can configure your browser in such a way that nexturban.at no longer can store cookies on your computer (if you do so, you also would have to delete the already existing ones). If you disable all cookies, this might affect your user experience negatively.

1.5 Logging and protocols

When you visit nexturban.at, your internet access provider and, depending on your settings, your browser makes certain information accessible to us, such as your IP address, time and date of your visit and its length, the operating system used, version and language settings of your browser, as well as the hyperlinks contained on a nexturban.at webpage you have clicked on and how you move through the website. If you have reached nexturban.at through a link on a different website, it is possible to see that website as well. If you have reached nexturban.at through a search engine, it is possible to see which words you have used in the search.

We process the mentioned types of data to pursue our legitimate interests pursuant Art 6(1)(f) GDPR, which are:

  • facilitating flawless connections to our website
  • ensuring our website can be used comfortably
  • analysing system security and stability
  • further technical-administrative purposes.

These logfiles are automatically deleted after 30 days. In case there was a security incident, we will retain individually involved records longer than this period for forensic purposes, and only delete these records after fulfilment. In any case, full IP addresses are only accessible by specially designated persons in our IT department and will not processed for any other purpose than investigating a security incident.

1.6 Transfer of your personal data

We do not transfer your personal data to third parties unless you have explicitly consented to such a transfer or we are entitled or obligated to do so, for example based on Art. 6 GDPR or under the laws of an EU or EEA member state. In some instances, we use third parties as data processors as allowed under the GDPR, and whenever we do so, next:urban technologies GmbH remains fully responsible for that processing as the data controller.

From time to time, we transfer the personal data you have entrusted us with between individual companies belonging to the next:urban group of companies, for the purposes mentioned above. The next:urban internal transfer is made on the basis of our legitimate interest to offer you more complete and integrated services or in order to fulfil our contractual obligations towards you.

1.7 Plugins 

1.7.1 Google Maps

To easily show you how you can find our offices and in which countries we have customers and references, we have integrated Google Maps into our website.

By visiting a page on our website which features a Google map, a connection to a Google server is made, and in this process the data made available by your browser, such as your full IP address, is collected and processed by Google. Google’s privacy notice can be found at https://policies.google.com/privacy.

Google Maps is operated by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

To better inform you about what we do at next:urban, we have embedded video clips on certain pages of our website which are hosted by YouTube.

By visiting a page on our website which has an embedded clip hosted by YouTube, a connection to a YouTube server is made, and in this process the data made available by your browser, such as your full IP address, is collected and processed by YouTube.

YouTube is operated by YouTube LLC, with its business seat in 901 Cherry Avenue, San Bruno, CA 94066, USA (“YouTube”). YouTube is affiliated with Google LLC, and YouTube’s privacy policy currently points to Google LLC’s privacy policy, which can be found at https://policies.google.com/privacy.

Our website uses Google Analytics, a web analysis service from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). Google Analytics uses so-called cookies, text files that are stored on your computer and allow analysing how you use our website. The information contained in these cookies (including your shortened IP address, so you remain anonymous towards Google) is transferred and stored on a Google server in the US. 1.8 Your rights as a concerned person

We hereby inform you that pursuant to Article 15 et seq. GDPR you have the right to obtain information on the personal data concerning you, as well as rectification or deletion or limitation of processing or of a right to object to processing as well as of the personal data right to have data portability.

Likewise, under Article 77 of the GDPR, you have the right to complain to a data protection super­visory authority if you consider that the processing of your personal data in breach of the GDPR.

If the processing is based on Article 6(1)(a) GDPR or Article 9(2)(a) GDPR (consent), you also have the right to revoke the consent at any time without affecting the legality of the processing on the basis of the consent until the revocation. As a user of our website, you have this right when you have registered for a newsletter or as a job applicant, for example.

1.9 Change of our data protection policies and statements

We reserve the right to amend this Privacy Policy from time to time so that it will always comply with legal requirements or when we change our services.
